Delta keeps toehold at Love Field, for now, over Southwest objections

Delta can stay at Dallas Love Field, at least temporarily, despite Southwest Airlines’ attempt to jettison its rival from the booming airport, a federal appeals court has ruled. The US Fifth Circuit Court of Appeals in a 2-1 ruling upheld a district court injunction that blocked Dallas-based Southwest from booting Atlanta-based Delta while the case moves to trial. A spokesman for Southwest said Friday that the airline will continue its legal battle for fulltime use of Gate 15 at Love Field. The dueling airlines split access to the gate now. Southwest, which leases the gate from the city-owned airport, claims Delta is trespassing and interfering with its operations by using the gate. Delta contends that Southwest, which has sole use of 18 of Love Field’s 20 gates, is unfairly monopolizing the airport. Southwest operates 180 flights per day at Love Field, compared with five by Delta. The district and appellate court ruled that Delta's chances of winning at trial are strong enough that it should not be squeezed out of the airport before the case goes to trial or is otherwise permanently resolved.<br/>
